SUBJECT : Eviction due to violation of Article 12 of Law No. 6570
EXPLANATIONS : The Defendant resides as a tenant in the apartment belonging to the client located at the address …. under a written lease agreement dated ../../…. with a monthly rent of ………. TL.
Despite the condition in the lease agreement that the leased property cannot be transferred to another party, the defendant leased the property to ………… on ../../….
Upon learning of this situation, my client notified the defendant via a letter of formal notice dated ../../…. and numbered ….. from the …… Notary Public that he did not consent to this and demanded that the leased property be restored to its original condition within one month.
As the defendant failed to restore the leased property to its original condition despite this letter of formal notice, it became necessary to file this lawsuit.
REASONS: Law No. 6570, BK, HUMK,
EVIDENCE: Lease agreements, witness statements, formal notice, expert examination, legal and discretionary evidence, etc.
CONCLUSION: For the reasons explained above, we respectfully request and demand that the defendant be evicted from the property he/she is occupying, that the costs of the proceedings be borne by the defendant, and that the opposing party’s attorney’s fees be awarded to us as attorneys, in accordance with the last paragraph of Article 164 of the Attorney Law No. 1136, as amended by Law No. 4667. ../../….
