SUBJECT OF THE CASE: It consists of a request for the evacuation of the leased property upon termination of the contract due to the fact that the leased property has been leased to a third party by the lessee.
EVENTS: 1- Defendant Tenant K, property of my client Lessor …. and ……… city, ………. in the apartment located at the address of ………….. in the district …………. resides as a tenant in accordance with the initial lease agreement and is still monthly ……. pays rent.
2- Defendant Tenant ……. In the last article of the lease agreement made between me and my client, under the title of special provisions; It is stipulated that “during the continuation of the lease agreement, the lessee cannot rent the leased property to a third party, otherwise the situation in question will be a reason for eviction”.
3- Despite this, the main tenant, the defendant Tenant ….. leased the rented property belonging to my client to another defendant sub-tenant ……, who is a third party, and he himself completely moved from the said flat and settled in his own house.
4- This situation is clearly in violation of the lease agreement, as well as the prohibition of sub-lease regulated in the article ………. In order to remedy the aforementioned violation, my client sent a warning to the defendant with the notice dated ……… and the journal number …….. of the Notary Public of ………. Although it was warned that the contract will be terminated and an eviction lawsuit will be filed against him, no result has been obtained and the lease agreement between the main tenant and the other defendant has not been terminated.
5- In this respect, it is obligatory to file this lawsuit in order to decide on the dismissal of the defendant upon termination of the lease agreement, since by leasing the leased property to a third party, he acts in violation of both the express provisions of the contract and the prohibition of sub-lease regulated in the article ……….
