TO THE HONORABLE COURT
PLAINTIFF:
ATTORNEY:
DEFENDANT:
SUBJECT: Our Request for Annulment of Marriage.
EXPLANATIONS :1-Our client married the defendant through an arranged marriage. Their marriage was solemnized on ……. at the ……. Marriage Office. The marriage records are located in ……. Province, ……. District, ……. Neighborhood, ……. Volume No., ……. Page No., and ……. Register No.
2- Our client and the defendant did not have the opportunity to get to know each other for a long time. After getting married, our client noticed some abnormalities in the defendant. Some of these include avoiding sleeping in the same bed and not undressing in front of our client. With our client’s insistence, it was revealed that the defendant is actually intersex.
3- The defendant, who had been receiving treatment for this condition for years, concealed it from our client. Had our client been aware of the defendant’s condition, he would never have entered into this marriage.
4-Our client made a fundamental mistake, but was also misled by the defendant in this regard. We reserve our right to pursue material and moral damages due to the comical situation he found himself in within society and the expenses he incurred for the marriage.
5-We request the annulment of the marriage contract between our client and the defendant.
LEGAL GROUNDS: MK.m.112 et seq.
EVIDENCE: Population registry, Legal and Discretionary Other Evidence, etc.
RESPONSE PERIOD: 10 days.
RESULT OF THE REQUEST: We request that the marriage contract be annulled for the reasons stated, that the costs of the proceedings be borne by the defendant, and that the opposing party’s attorney’s fees be awarded to us as attorneys, in accordance with the last paragraph of Article 164 of the Attorney Law No. 1136, as amended by Law No. 4667.
